Arrested again, months after his 1st murder charge, with help from K9 deputies

A man who is no stranger to at least one Florida jail is back behind bars, charged with murder, thanks to some K9 deputies.

The crime happened in a homeless camp in the woods near Winter Haven last Nov. 8.

A deputy learned the victim, whose name has not been released, was dead “in a tent with multiple gunshot wounds.”

According to an affidavit, Enrique Martinez “entered the tent and asked the victim to step outside.

“The victim refused to do so.

“The victim then stood up and at that time the suspect pulled a firearm, pointed it at the victim, said his name, and fired three shots which ended up killing the victim.

“The suspect then fled the area on his bicycle.”

One witness said she and Martinez had “been in a relationship for approximately a week.”

The affidavit said Martinez asked her “if the victim was inside the tent, to which [she] replied ‘yes.’

“[She] then went on to tell the suspect, ‘don't start no s***.’

“[She] advised the suspect walked over to the tent and she could hear a conversation being had.

“Next thing [she] heard was multiple gunshots.“[She] ran over to the tent and observed the suspect walking away with a gun in his right hand.“[She] began yelling ‘why would you do this’ and ‘I hate you.’

No possible motive was given in the affidavit from November, which ended by saying, “There was no evidence of a struggle or fight,” and that “Enrique Martinez, Jr., was convicted of two counts of felony battery domestic violence” on June 14, 2017.

At that point, authorities got “an active murder warrant” to arrest Martinez and his arrest report said he “has been actively evading law enforcement” for the next two-and-a-half months.

It was on Jan. 23 that another deputy saw Martinez “attempting to cross” a street and activated “his emergency red and blue lights, and made a U-turn.”

He stopped “in front of the suspect” at an intersection “and commanded the suspect, Enrique Martinez, to stop.”But “he began to run away from my direction while reaching in his waistband,” the deputy wrote.

Meanwhile, the deputy who investigated the killing was in another car and tried to stop Martinez, but he escaped “into a heavily wooded area.”

Deputies and Winter Haven police “established a perimeter around the wooded area” and “Martinez refused to exit the wooded area after given lawful commanded [sic] to exit.”

Finally, “K9 deputies and their K9 partners arrived and when approaching the wood line, the suspect, Enrique Martinez, exited the woods and laid flat on his stomach.”

And he was arrested without incident.

The report added that upon arrest, “Martinez stated he threw a knife from his person into the wooded area he exited from.”

Also, the owner of the property “advised he has never provided the suspect, Enrique Martinez, permission to enter his enclosed property,” so on top of everything else, he was charged with resisting arrest without violence and trespassing, and taken to jail.

Martinez, 26, is also charged with first-degree murder, possession of a firearm by a convicted felon, possession of ammunition by a convicted felon, two counts of tampering with physical evidence, two other counts of resisting without violence, three counts of violating his pretrial release, and two counts of failure to appear.
